Ride the Tollways.
PNCC staff arrested for Contempt of Court
In spite of
the heavy rain on Sunday 19th August 2001 quite a large number of motorcycles
used the tollways. Typical comments were "Even riding in the
pouring rain its a real pleasure to ride without Jeepneys, tricycles
and buses swerving all over the road and not have to be paranoid
about vehicles coming out of side turnings."
Most of those
riding did not meet with any serious resistance from tollway staff
although we continue to get reports of riders being refused entry
because they do not have the "voluntary" sticker. In every
case we have heard of so far, the riders simply ignored the tollway
staff, took the ticket or paid the toll and continued on their way.
A few riders
have paid the 150 pesos for a voluntary ticket and are confused
at the registration process. We were told the tickets were to help
the tollway staff see which bikes are 400cc or over but the registration
procedure asks for a great deal of personal information that has
nothing whatever to do with the motorcycle's suitability for riding
a tollway and very little attention is given to the motorcycle.
The stickers also have a date indicating they will expect riders
to pay for another voluntary sticker every year. Do they think people
will put smaller engines in their bikes so they have to check again
every year? I wonder if the PNCC actually has anyone qualified to
check the bikes in the first place.
On Monday 20th
August 2001 two PNCC staff, Patrol Officer Rogelio Fernando and
Officer In Charge Gaoaen where arrested for contempt of court because
they stopped and ticketed riders using the tollway after the court
ruled on July 16 that the TRB have no power to ban motorcycles and
therefore the ban is void and illegal. The judge ordered the two
PNCC staff arrested and imprisoned for thirty days.
The tollways
are continuing to ban bikes under 400cc and are forcing them to
leave the tollways or issuing tickets and taking the rider's licenses.
The LTO is observing the court ruling and simply returning the riders
licenses with no fines to pay and the writ of preliminary injunction
is still in force so issuing tickets to riders of ANY motorcycle
(except tricycles) riding on the tollways is likely to result in
more charges of contempt of court and more of the tollways staff
being used as sacrificial lambs by their superiors.
Some of the
Freedom Riders MC enjoyed an almost hassle free ride after the weather
started to clear and took some snapshots of the ride. (A friend,
Fidel, was stopped at the exit and the guard demanded to see a sticker)
